The Public Authority for Manpower (PAM) has launched an awareness campaign to help both employers and domestic workers understand their rights and responsibilities under Kuwait’s labor laws. If you employ a domestic worker—or are one—here’s what you need to know.
End-of-Service Indemnity: One Month Per Year
Under Article 23 of Law No. 68 of 2015, domestic workers are entitled to an end-of-service gratuity equal to one month’s salary for each year of service. This payment is due when the employment contract expires or is terminated.
The Six-Month Guarantee Period
If a domestic worker leaves during the first six months (the guarantee period), employers should contact the Domestic Workers Recruitment Department to secure their right to a refund. Importantly, workers should not be returned directly to the recruitment agency during this period—employers must coordinate with PAM to determine the cause and arrange proper transfer procedures.
Contracts and Transfers
All domestic workers must be employed under the standard recruitment contract approved by PAM. This official document outlines the rights, duties, and protections for both parties. Transferring a worker to another employer without the department’s consent—especially during the guarantee period—will result in forfeiture of the guarantee.
Mobile Phone Rights
Domestic workers are entitled to own and use a mobile phone outside working hours. This right is protected under Article 5, Paragraph 9 of the standard tripartite employment contract. Employers must respect workers’ privacy during non-working hours.
Payment Documentation
Monthly salaries must be documented through payment vouchers or bank transfers to ensure transparency. Employers should also obtain a payment receipt or notarized contract showing the recruitment agency’s name and signature.
Working Outside Kuwait
Employers cannot require domestic workers to perform duties outside Kuwait without their consent. Additionally, employers are responsible for covering repatriation costs when the contract ends.
