Life in Kuwait can change unexpectedly—whether through the death of a sponsor, deportation, imprisonment, or a residency expiring while abroad. The Residency Affairs General Department at Kuwait’s Interior Ministry has outlined the procedures for handling these difficult situations. Here’s what expatriate families need to know.
If Your Sponsor Passes Away
When a sponsor holding a residency permit under Article 17 or 18 dies, the sponsored family members must contact their respective governorate’s residency department. The wife and children’s cases will be reviewed, and their residency permits can be transferred to the wife—provided she is already employed or obtains employment.
If Your Sponsor Is Deported
If the husband is deported and the wife is unemployed, the residency permits of the wife and children are canceled. However, if the children are enrolled as students, they may be given a notice allowing them to remain in the country until their studies are completed.
If the Sponsor’s Residency Expires While Abroad
When a sponsor’s residency expires while he is outside Kuwait, the dependents should visit their governorate to process their affairs. If the mother is employed, the children can be transferred to her sponsorship—provided they are enrolled in school. The same rules apply if the husband is imprisoned.
If the Husband Is Imprisoned
When an expatriate husband is in Central Prison and the wife does not work, her residency will not be renewed. However, if she is employed, the case is reviewed with the possibility of transferring the children to her sponsorship.
Children of Kuwaiti Women Married to Non-Kuwaitis
If a Kuwaiti woman’s non-Kuwaiti husband passes away, her children under sponsorship are given the opportunity to find work or transfer to Article 24 (self-sponsorship), provided the mother’s Kuwaiti nationality is established.
Widows and Divorcees of Kuwaiti Citizens
A widow or divorcee of a deceased Kuwaiti citizen who has no children may be allowed to transfer her residency after the governorate reviews her case. A widow with no children but receiving a pension is also eligible to transfer her residency.
Sponsors with Mental Disabilities
In cases where the sponsor has a mental disability, the residency departments in each governorate will study the cases of those under sponsorship. Children’s residency may be transferred to the mother if she is aware of the situation and able to take responsibility.
